Terms of Use

These terms are an agreement between you and M3E Brands ("OpenSet," "we," "us") covering your use of the OpenSet app. By creating an account you agree to them. If you don't, don't use OpenSet.

1. Who can use OpenSet

You must be at least 13 years old. If you're under the age of majority where you live, you may only use OpenSet with a parent or guardian's permission. You confirm your age when you create an account.

2. Your account

You're responsible for what happens under your account, including keeping your password to yourself. Tell us at [email protected] if you think someone else has access to it.

One person, one account. Don't impersonate anyone, and don't create an account to get around a removal or a block.

3. Your content stays yours

You own what you post. Workouts, photos, posts, comments — they're yours, and these terms don't change that.

To actually run the app we need your permission to store and display what you post to the people you chose to share it with. So you give us a limited, non-exclusive, royalty-free licence to host, store, reproduce and display your content for the purpose of operating OpenSet — and nothing else. We do not sell your content, licence it to anyone else, or use it in advertising.

That licence ends when you delete the content or your account, except where a copy has already been shared onward with other members in a way we can't reach, and except for backup copies that expire on their normal schedule.

4. What you may not do

You agree not to post or do the following. The full detail lives in our Community Guidelines, which form part of these terms:

• Harassment, bullying, hate speech, threats, or targeting someone
• Sexual content or nudity
• Content promoting illegal activity
• Dangerous training advice, or promotion of drugs or supplements in a way that puts people at risk
• Impersonating another person, gym, or brand
• Spam, scams, or bulk unsolicited messaging
• Posting someone else's private information
• Attempting to break, overload, scrape, or reverse-engineer the service, or to access accounts or data that aren't yours

5. Moderation, removal, and appeals

We review reported content and may remove content or restrict an account that breaks these terms or the Community Guidelines.

Removal is reversible. If we take something down and we got it wrong, we can put it back. Email [email protected] to appeal and a human will look again.

We aim to respond to reports of threats or immediate safety risks the same day, and to other reports within 24–48 hours. These are targets, not guarantees.

6. OpenSet is not medical advice

OpenSet is a training log and a community, not a medical service. Nothing in the app — including personal records, progress charts, training observations, or anything another member tells you — is medical advice, diagnosis, or treatment.

Exercise carries risk of injury. Talk to a qualified physician or coach before starting or changing a training programme, especially if you have a medical condition or are recovering from injury. You train at your own risk.

Content posted by other members is theirs, not ours, and we don't endorse or verify it.

7. Automated community accounts

Some accounts in the app are operated by us and post automatically to help start conversations in new or quiet gym communities. Every one of them is visibly labelled "Community Starter" and says so on its profile. We do not operate undisclosed accounts that present as real members. See our Privacy Policy for detail.

8. Subscriptions

OpenSet is free to use. Some features are part of an optional paid subscription.

Subscriptions are billed through the App Store or Google Play, renew automatically until cancelled, and are cancelled and refunded through your Apple or Google account — we cannot cancel or refund on your behalf, because we never handle the payment. Prices are shown before you buy. If we change the price of an existing subscription, we'll tell you first.

9. Ending your account

You can delete your account at any time in Settings → Delete Account. It is immediate and permanent.

We may suspend or terminate an account that seriously or repeatedly breaks these terms, or where we're required to by law. Where we can, we'll tell you why.

10. The service changes, and sometimes breaks

OpenSet is provided "as is." We don't promise it will be uninterrupted, error-free, or that your data will never be lost, though we take reasonable care and keep backups. We may add, change, or remove features.

To the fullest extent the law allows, M3E Brands is not liable for indirect or consequential losses, and our total liability to you is limited to the greater of the amount you paid us in the preceding twelve months, or $50. Some places don't allow these limits, in which case they don't apply to you.

11. Governing law

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

12. Changes to these terms

If we make material changes we'll tell you in the app before they take effect. Continuing to use OpenSet after that means you accept the new terms.
